TERMS & CONDITIONS, REFUND POLICY, AND LIABILITY WAIVER

For BocaRaton.com, Inc. & Children’s Giving Foundation Events

By purchasing a ticket and/or attending any BocaRaton.com, Inc. or Children’s Giving Foundation event, including the Florida Tacos, Wings & Desserts Battle, you agree to the following Terms & Conditions, Refund Policy, and Liability Waiver.

1. EVENT TERMS & CONDITIONS

  1. Event Beneficiary: This event benefits Children’s Giving Foundation, a 501(c)(3) nonprofit based in Boca Raton.
  2. Ticket Inclusions: Your ticket price includes all food & beverage tastings – there are no additional fees for sampling.
  3. Retail Shopping Bazaar: Separate retail vendors will be selling products, so be sure to bring extra cash or card if you wish to purchase items.
  4. Rain or Shine Policy: The event will take place rain or shine. There are no refunds or exchanges under any circumstances.
  5. Alcohol Consumption & ID Requirements:
    • Attendees must be 21 years of age or older to consume alcohol.
    • A valid government-issued photo ID is required upon entry.
    • We urge all guests to drink responsibly.
  6. Food & Beverage Changes: Participating chefs, distributors, and vendors may modify menu offerings. BocaRaton.com, Inc. and Children’s Giving Foundation are not responsible for any changes.
  7. Pets & Safety Precautions:
    • Pets are not allowed at this event due to safety concerns (unless certified and wearing the service vest).
    • Cooking stations may include hot grills, open flames, and high-temperature cooking surfaces. Attendees must be cautious and assume all risks.
  8. Photography & Videography Release:
    • By attending, you grant BocaRaton.com, Inc., Children’s Giving Foundation, Sponsors, Vendors, and Media Partners the right to use any photographs, video, or audio recordings taken at the event for marketing, advertising, and promotional purposes in perpetuity, without compensation or notification.
  9. Prohibited Items: no weapons of any kind, drugs, outside food and drink, very large bags/suitcases, vaping, cigarette smoking
  10. Ticket Purchase Assistance: If you need assistance purchasing tickets via phone, call 561-338-7594 between 8 AM and 9 PM, 7 days a week.

2. REFUND POLICY

  1. All ticket sales are final. There are no refunds, transfers, or exchanges once a ticket has been purchased.
  2. No Show Policy: If an attendee fails to attend, no refund or compensation will be provided.
  3. Event Cancellation: If the event is canceled due to unforeseen circumstances, ticket holders may be offered rescheduled event dates or credit toward a future event, but no cash refunds will be issued.
  4. Force Majeure: BocaRaton.com, Inc. and Children’s Giving Foundation are not liable for refunds or damages if the event is canceled or rescheduled due to acts of God, weather conditions, government restrictions, pandemics, public emergencies, or any other causes beyond our control.

3. LIABILITY WAIVER & RELEASE OF CLAIMS

  1. Assumption of Risk

By purchasing a ticket and attending the event, you voluntarily assume all risks associated with participation, including but not limited to:

  • Foodborne illness or allergic reactions
  • Personal injury, illness, or property damage
  • Exposure to communicable diseases, including COVID-19
  • Risks related to alcohol consumption, open flames, or high-temperature cooking equipment

You agree to release, waive, and hold harmless BocaRaton.com, Inc., Children’s Giving Foundation, Sponsors, Vendors, Media Partners, Affiliates, Employees, and Volunteers from any and all liability, claims, losses, or expenses arising out of or related to your participation in this event.

  1. Indemnification Clause

You agree to indemnify and defend BocaRaton.com, Inc., Children’s Giving Foundation, and all event affiliates against any claims, damages, liabilities, and expenses (including legal fees) arising from your negligence, misconduct, or failure to follow event policies.

  1. Alcohol Responsibility Disclaimer
  • BocaRaton.com, Inc. and its affiliates do not encourage excessive alcohol consumption and assume no responsibility for accidents, injuries, or damages resulting from alcohol consumption at the event.
  • Guests are responsible for arranging safe transportation if consuming alcohol.
  1. COVID-19 & Communicable Disease Disclaimer
  • Attendees acknowledge that participating in public events carries an inherent risk of exposure to COVID-19 or other communicable diseases.
  • By attending, you voluntarily assume all risks related to exposure and agree that BocaRaton.com, Inc., Children’s Giving Foundation, and all event affiliates are not responsible for any illness or health-related consequences.

4. AGREEMENT TO TERMS

By purchasing a ticket and attending the event, you acknowledge that you have read, understood, and agreed to these Terms & Conditions, Refund Policy, and Liability Waiver.
